  1. TERMS AND CONDITIONS – Covid19

00.1 Farms2Fork is a trading name of Named Boxes Ltd, 69 Lambeth Walk, London, England, SE11 6DX. The temporary trading address is Ground Floor, 78 Church Road, Barnes, London, SW13 0DQ. Telephone 0203 918 0771.

00.2 We aim to deliver your order within 5 working days of it being placed and paid for. To offer Free Delivery we must utilise Royal Mail to keep the cost down.  You can select to pay £9.95 for speedy delivery and we will send your order by UPS Next Working Day from the date of dispatch.

00.3. Orders for Next Day Delivery must be placed before 2pm. Orders received after this time will be sent with UPS the next working day.

00.4 Once your order has left us we pay UPS for their Next Day Delivery service, if they then fail to deliver within the time frame given we cannot be held responsible for something beyond our control. We are sure you are aware that all carriers are experiencing delays during these unprecedented times.

00.5 This website and service has been launched in a very short timescale as a Crisis Service in the middle of a Global Pandemic. Our staff are all volunteers but are risking exposure to Covid-19 by coming into work, despite all the good measures we have put in place for their safety, to provide a service to the General Public. Please respect that and if you are not happy with the service we provide or goods when they arrive your only recourse is to not order from us again. We would have done our best in very difficult working conditions and done the work that you asked – but if you are not happy we can only apologise.

00.6 We rely on Royal Mail once the item has left us so if it does not arrive as you wished, we will provide proof of posting and you can take your grievance up with them but please don’t send us rude emails and correspondence demanding huge compensation as we have resorted to using Royal Mail due to massive complaints about us charging for delivery at true cost. We have more control on your delivery if you select to pay for UPS as it is a tracked system and we can see where your parcel is so if you pay for the better service we can better assist you in the event of a problem – but again we are all only human and working in tough times so please do consider our rights as well as your own when writing or talking to us. 

00.7 UPS have been instructed to leave the goods on your doorstep, ring your bell or knock and take a picture of the goods delivered for our records.  Royal Mail will follow their own guidelines derived from Government guidance. 

00.8. Our own staff all wear protective masks and disposable gloves, and have a good supply of antibacterial hand wash that they will regularly use.  When at a running water source they will wash their hands regularly.  They will of course endeavour to keep two meters distance at all times from anyone else and regularly clean the vehicle back and cab with anti-bacterial cleaning agents.  We will ensure all our workers are free from symptoms.

00.9 Farms2Fork donated all excess Fresh Produce to local food banks for free that was distributed to the Vulnerable and those needing it before the Government Free Food System kicked in.  We also offered to do free home deliveries of Government Free food parcels to any areas we regularly work in once the Council system started working properly.

  1. BECOMING A CUSTOMER

1.1 To place an order with us, you must be over 18 years of age, require delivery and have a credit or debit card acceptable to us in your name.

1.2 We reserve the right to decline any order or to suspend your Account with us at our discretion.

1.3 Our Terms and Conditions will apply when you place your order.

  1. CONTRACT

2.1 This website is operated by Named Boxes Ltd t/a Farms2Fork. Once you have placed an order on the website you will receive an email confirmation, we will also call you to confirm your order before preparing. The email will list all products you have ordered, the price and delivery details if applicable. This is not an acceptance by us. A legally binding contract will only arise once we have completed delivery of the goods to you.

2.2 If you have entered an incorrect email address and receive no email purchase confirmation and/or any other details are incorrect then the onus is on you to contact us to amend your details and we cannot be held responsible for the entering of incorrect information or your email service provider spam filtration.

  1. AMENDING OR CANCELLING THE CONTRACT

3.1 Should you wish to amend or cancel your order you must let us know by email or phone as soon as possible after placing your order. We will begin preparing your order as soon as we have confirmed it with you.

3.2 Where you order includes goods that are unavailable for any reason, we shall notify you and we will either send a replacement product or organise a refund.

  1. PRICE AND DELIVERY CHARGES

4.1 The price of the goods will be as quoted on the website at the time you confirm your order and will be inclusive of VAT (if applicable) or any other tax and, subject to paragraphs 4.2 and 5 below, delivery.

4.2 The delivery charge applying to your order shall be set out at the time you checkout. All orders to Mainland UK are sent out for free by Second Class Royal Mail and you can elect to pay £9.95 for next working day UPS Courier.  Any furniture items shall be subject to a one-man delivery charge of £80.

4.3 If you amend your order the price charged will be the price quoted at the time you amend the order. The delivery charge shall be amended and applied in accordance with paragraph 4.2.

4.4 We will debit the total cost of your order, including any delivery charge or packaging cost that may be applied, from your debit or credit card at the time you place your order.

  1. DELIVERY

5.1 We will always aim to deliver your order at the time arranged with you.

5.2 In the event that nobody is available to take delivery of your order at the delivery address or you ask us to leave your goods unattended at a secure place, Named Boxes Ltd t/a Farms2Fork expressly disclaims all liability that may arise in consequence of the delivery being left unattended, including, without limitation, theft, tampering or contamination, however caused.

5.3 Events outside our control, for example, epidemics, extreme weather conditions, may occasionally mean we are unable to deliver your goods at the time agreed. In these circumstances, we will contact you as early as possible to rearrange the delivery time. In such an event, our liability to you shall be limited to the price of the goods ordered and the cost of delivery.

  1. WHAT WE WILL NOT BE LIABLE FOR

6.1 We will not be liable for any indirect or consequential loss or damage of loss of profits arising out of our supply or failure to supply the goods to you.

6.2 Nothing in this Agreement shall in any way limit our liability for death or personal injury resulting from our breach of contract, tort or negligence nor limit any legal rights you have as a consumer.

6.3 Some of our products may contain traces of nuts and other allergens. We will ensure that the contents of each box are clearly listed on our website but it is your responsibility to ensure that you have read the information. If you require further information on allergens, please contact us.

6.4 The goods are sold to you on the basis that you are a consumer therefore we will not be liable for any special losses that you might suffer using, distribution or reselling the goods as part of a business.

6.5 We shall not be liable for goods once they have been delivered to the address or secure place stated in your order.

6.6 Our packaging is designed to ensure our produce reaches you in perfect condition but it is your responsibility to ensure that all perishable goods are refrigerated as soon as possible upon receipt. Further, if you or a third party moves, transports or delivers the goods to any other address following our delivery, we shall not be liable for anything that that third party might do to the goods or any subsequent deterioration in the produce

  1. GENERAL

7.1 These terms and conditions set out the entire agreement between us. Any failure by us to enforce any of our rights under this Agreement shall not prejudice our entitlement to rely on any of our rights in the future.

7.2 We shall not be liable for delays or failures to perform our obligations if that delay of failure arises from events beyond our reasonable control.

7.3 We reserve the right to change our website, policies and terms and conditions at any time but this shall not affect the terms and conditions prevailing at the time you make a purchase.

7.4 Whilst we take the utmost care to ensure that all product descriptions, images, information and prices are accurate, we do not accept any liability for any inaccuracies, errors or omissions. Colour and shape may vary from those shown on the website.

7.5 This Agreement is governed by the laws of England and Wales and both parties hereby submit to the exclusive jurisdiction of the English courts
